Decision A

CCS district’s policies are for bullying/threatening another student is a Class II Violation.  Punishment can range from 10 day suspension from school to 45-365 day long term suspension at alternative school.  Rosie’s mom contacts Emily’s parents, who then make her cancel her social network page and apologize to Rosie. If Rosie and her mom go to the police about the constant threats, Emily could be charged with Cyber Bullying (Class 2 misdemeanor because Emily is under 18, punishable by 1 – 60 days in jail), Using Electronic Mail or Communication to Threaten or Extort (Class 2 misdemeanor, punishable by 1 – 60 days in jail).  . If Emily takes naked photos of Rosie in the locker room without Rosie’s permission and posts them, she could be charged with Disseminating Images Obtained in Violation of Peeping Statute (Class H felony, punishable by up to 30 months in prison), and Disclosure of Private Images (Class 1 misdemeanor, punishable by 1 – 120 days in jail).   If Emily is convicted of this charge, the Court could order her to register as a Sex Offender.
